Unable to Recall or Gate while Grey

So I have determined that one is unable to Recall or use Rune books while Grey (criminal)
BUT
I have seen Reds (PK murderers) Recall and Gate all the time..
What is the deal?

What is the deal?

The status of Red is not the same as criminal (grey). When you are criminal, you are grey and cannot do things like recall away When you are red and have not committed a criminal activity (recently), you are free to recall around as normal. If a red does commit a criminal action, they are flagged criminal and while they do not turn grey (red trumps grey), they hold the status for 2 min or so.

Ah I see.. So if a PKer engages you they are unable to recall or Gate until they finish the battle. seems fair I guess
